1. Agreement to Terms

By accessing and using CloudDriveRAG ("Application," "we," "us," "our," or "Service"), you accept and agree to be bound by and comply with these Terms of Service ("Terms"). If you do not agree to abide by the above, please do not use this Service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on CloudDriveRAG for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modifying or copying the materials (except as expressly provided in these Terms)
• Using the materials for any commercial purpose or for any public display
• Attempting to decompile or reverse engineer any software contained on the Application
• Removing any copyright or other proprietary notations from the materials
• Transferring the materials to another person or "mirroring" the materials on any other server
• Violating any applicable laws or regulations
• Accessing or using the Application in any way that could damage, disable, overburden, or impair our servers or networks

3. Self-Hosted Application

CloudDriveRAG is designed as a self-hosted application. You are responsible for:

• Installing and configuring the Application on your own infrastructure
• Maintaining security of your deployment and API keys
• Ensuring compliance with applicable laws in your jurisdiction
• Protecting against unauthorized access to your instance
• Maintaining backups of your knowledge base and configuration

4. Acceptable Use

You agree not to use CloudDriveRAG:

• For illegal purposes or in violation of any applicable laws or regulations
• To process, transmit, or store malware, viruses, or harmful code
• To harass, threaten, or defame any person or entity
• To infringe upon any intellectual property rights
• To distribute copyrighted content without authorization
• To interfere with or disrupt the integrity or performance of the Application
• To engage in unauthorized access or intrusion attempts
• To violate third-party rights, including privacy, publicity, or intellectual property rights

5. Your Content and Data

5.1 Responsibility for Content

You are responsible for any content you upload, ingest, or process through CloudDriveRAG, including documents from Google Drive. You represent and warrant that:

• You own or have the right to use all content processed by the Application
• The content does not infringe upon any third-party rights
• You comply with all applicable laws regarding the content

5.2 Data Ownership

You retain all ownership rights to your data. CloudDriveRAG does not claim ownership of your documents, embeddings, or any derived content. You grant us the right to process and store your data only as necessary to provide the Service.

6. Third-Party Services

CloudDriveRAG integrates with third-party services:

• Google Drive API: Subject to Google's Terms of Service and Data Processing Addendum
• OpenAI API: Subject to OpenAI's Terms and usage policies
• Google Gemini API: Subject to Google's Terms of Service
• Qdrant Vector Database: Subject to Qdrant's Terms (for cloud deployments)

You agree to comply with the terms and conditions of these third-party services. We are not responsible for their content, practices, or policies.

7. API Keys and Credentials

You are solely responsible for:

• Providing valid API keys from Google, OpenAI, or other services
• Paying all associated costs with API usage
• Protecting your API keys from unauthorized access
• Revoking access if keys are compromised
• Monitoring your usage and costs with third-party services

8. Disclaimer of Warranties

THE APPLICATION AND ALL MATERIALS AND INFORMATION IN THE APPLICATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE APPLICATION OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED IN THE APPLICATION. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

IN NO EVENT SHALL CLOUDDRIVE RAG OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON CLOUDDRIVE RAG, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

10. Accuracy of Materials

The materials appearing on CloudDriveRAG could include technical, typographical, or photographic errors. We do not warrant that any of the materials in the Application are accurate, complete, or current. We may make changes to the materials contained in the Application at any time without notice.

11. Limitation on Use

We reserve the right to limit the use of the Application to prevent abuse, such as excessive API calls, storage consumption, or attempts to overwhelm system resources. Users exceeding reasonable usage thresholds may have their access restricted.

12. Intellectual Property Rights

CloudDriveRAG is provided under an open-source license (see GitHub repository for specific license terms). You may use, modify, and distribute CloudDriveRAG in accordance with the applicable open-source license.

All content generated by the Application based on your documents (vector embeddings, search results) remains your intellectual property.

13. Governing Law

These and all related agreements, documents, and transactions are governed by and construed in accordance with the laws of the jurisdiction where the Application is deployed. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction.

14. Modifications to Terms

We may revise these Terms of Service for the Application at any time without notice. By using this Application, you are agreeing to be bound by the then current version of these Terms of Service.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
